Andhra Pradesh government reaches Supreme Court against Chandrababu Naidu’s bail, alleges scam

New Delhi : The Andhra Pradesh government on Tuesday moved the Supreme Court against the High Court’s order granting regular bail to Telugu Desam Party (TDP) chief N Chandrababu Naidu in the Skill Development Corporation scam case. Seeking a direction to quash the High Court’s decision, the state government said the accused (Naidu) is an influential person and two of his key associates (including a government employee) have already fled the country. It has been said in the petition that the accused is clearly obstructing the investigation, hence he should not be granted bail.

Andhra Pradesh High Court, while granting bail to Naidu on November 20, had said that the discretion to grant bail should be exercised in a humane and compassionate manner. The state government, in its appeal, said that in its 39-page judgment the High Court not only conducted a short hearing but also completely erred in arriving at findings which are completely contrary to the record.

The government expressed fear that the court action would be affected.

In the petition filed by advocate Mahfooz Ahsan Nazki, it has been said that the present special leave petition is bound to be filed against the decision given by the Andhra Pradesh High Court in Amaravati, Andhra Pradesh on November 20. The petition said that the High Court has delved into the facts of a bail case and has given findings which are not only factually incorrect but are also likely to prejudice the trial court during the trial.

High Court held short hearing on bail petition

Referring to various judgments of the Supreme Court, the Andhra government said that the practice of detailed description of evidence in bail orders has been repeatedly criticized by this court. The petition said that looking at the findings shows that the High Court has violated its jurisdiction by holding a short hearing and giving findings on merits.

Chandrababu Naidu will get relaxation in bail conditions from November 29

The High Court had converted Naidu’s four-week interim medical bail into regular bail in this case and ordered the release of the former Chief Minister on regular bail considering his age, various ailments, not being a flight risk and other reasons. The High Court had said that interim bail conditions like refraining from making any public comments or organizing or participating in public rallies and meetings related to the Skill Development Corporation scam case will remain in force till November 28 and will be relaxed from November 29. . Further, the court directed Naidu to present his medical report before the special court in Vijayawada on or before November 28 instead of handing over his medical report to the superintendent of Rajamahendravaram Central Jail.
