West Bengal: Court directs Center to file an affidavit on the allegation of deactivation of Aadhaar card

West Bengal : Calcutta High Court (Calcutta High Court) on Thursday directed the Center to file an affidavit on that PIL. In which the concerned authorities have been accused of deactivating the Aadhaar cards of the people. Additional Solicitor General (ASG) Ashok Chakraborty raised questions on the maintainability of the PIL, saying that the petition does not involve personal data of any person affected by such action. The division bench headed by Shivagananam directed the Center to file an affidavit within three weeks clarifying its position on the allegations made in the PIL.

The next hearing of the case will be on April 25.

The petition has claimed that people’s Aadhar cards are being arbitrarily deactivated using the provisions under Section 28A of the Aadhar Act. Directing the petitioner to also file his affidavit, the bench said that the next hearing of the case Will be done on 25th April. ASG said that Section 28A of the Aadhaar Act pertains only to foreign nationals.

Petitioner’s lawyer Jhuma Sen said that the provisions for deactivating Aadhaar card under Section 28A are beyond the scope of the Aadhaar Act and arbitrary. This PIL has been filed by an organization called ‘Joint Forum Against NRC’.
