WB News: High Court allows victim’s family to take possession of body in case of custodial death.

A division bench of the Calcutta High Court on Saturday approved the petition to hand over the body of Ashok Sao to his family. Ashok Sao reportedly died in the custody of Amherst Street police station this week. A division bench of Chief Justice TS Sivagnanam and Justice Hiranmoy Bhattacharya also directed that the body be shifted from the mortuary of SSKM Medical College and Hospital to his residence in central Kolkata under tight security and then to the crematorium.

The division bench has also directed the police to ensure that no tension or anarchy is created during the entire process. The police conducted post-mortem of the body. However, the post-mortem report rejected the possibility of physical attack on the victim and said that the cause of his death was internal bleeding.

The state BJP has termed the autopsy report as fabricated to protect the guilty policemen of Amherst Street police station. The BJP demanded a second postmortem of the body at a central hospital like AIIMS in Kalyani in Nadia district or the defence-run Command Hospital in South Kolkata. However, the family informed the Calcutta High Court that they were not interested in a second post-mortem.
