The court says that SSC is trying to hide something from the court. In this situation, the division bench directed SSC to submit a fresh report. It will have to be submitted by 20th December.

On this day, the School Service Commission presented its stand in the special bench regarding withdrawal of the recommendation letter on the question of appointment in class IX and X. The High Court said but the position of the Commission is not satisfactory. Expressing his opinion on this matter, the judge said why the Commission is hesitating in bringing all the information before the court. The division bench said that we have been seeking help from the School Service Commission for the last one month.

Justice Debanshu Basak asked the commission, we want to know from the first day whether there was any mistake in giving the recommendation letter through the School Service Commission, whether you had received it and if you had received it, what did you do with it. In this regard, the Commission says, we have found many irregularities. I presented him before the court. Then I worked as per the orders of the court.

He said that there is no provision in the Commission Act to withdraw the recommendation letter in the case of Group C and Group D. The division bench said, first of all it is important to know to whom the commission gave the recommendation letter. The court also said that if it is found that people other than those recommended by the Commission have received appointment letters, there is no need for the CBI to look into it.

According to the Central Education Council, apart from those who were given recommendation letters, no one was given appointment letter. According to the Commission, in the case of class 9th-10th, there was a mistake in giving recommendation letters of 183 people. Of these, 122 recommendation letters have been withdrawn. But the question of the court is why SSC did not withdraw the recommendation letters of the remaining 61 people. On which the court banned. The judge asked whether the Supreme Court has any suspension order or the High Court has any suspension order. The Commission replied ‘No’. Then the court commented that it should be withdrawn. These 61 people have no right to receive government salary. The Commission asked whether the Chairman of the Commission was afraid that if he did so he would be charged with contempt of court.
