WB: Calcutta High Court gives relief to BJP MLAs and says, don’t make national anthem a weapon

BJP MLAs booked for alleged contempt of national anthem in West Bengal Calcutta High Court A big relief has been received from (Calcutta High Court). Hearing the case, Justice Jai Sengupta has adjourned the case against the BJP MLAs till January 17. The next hearing of this case will be on January 10. Justice Jai Sengupta said, “The national anthem should be respected. It cannot be used as a weapon. The initial comment of the court was that on one side BJP MLAs were raising slogans. On the other hand, the ruling party was organizing a protest programme. Both incidents started at almost the same time.

Under what circumstances the national anthem will be played, it is a matter of decision

Justice Sengupta commented in this context, “A party wants to protest against the allegations of SSC corruption. You have played the national anthem since morning. So will they stop?” the judge said, the national anthem started from the second programme. His lawyer Rajdeep Majumdar said that the plaintiff side has also accepted this incident. He did not deny the allegations of the ruling party. But under what circumstances the national anthem will be played is a matter of decision. In such a situation, slogans were not raised before the national anthem started. The slogan was already going on. He further said that the ruling party should have understood the entire situation at that time. We will have to see what is going on there. After all the national anthem could have been started.

Video footage of that day was shown in the court

The judge’s government counsel Kishore Dutt commented, “Do you expect the playing of the national anthem to stop because of a riot? Its decision should be taken on the basis of some facts related to the incident. The Court has repeatedly kept two main issues in mind. Video footage of that day was shown in the court. Judge’s comment, what kind of footage has the police brought? One-sided gathering is shown. The other party is not on that camera. Consequently, if the footage is not viewed at the same time, how will it be understood that this slogan was given during the national anthem?

Justice Sengupta unhappy with the question of the state lawyer

Justice Sengupta seemed unhappy with the question of the state counsel. He said, the court wanted to hear the case after filing the affidavit. But the state does not have time to file the affidavit. I am surprised to see your stubborn stance in this matter. So important that it should be heard first? Okay, I am leaving out all the cases like murder and rape. You ask questions. This matter continued throughout the day. I will not take any case tomorrow also.

The national anthem was sung by the Trinamool camp.

Last Wednesday, during Trinamool’s protest program in the Assembly, BJP MLAs were also protesting. The national anthem was sung by the Trinamool camp. The controversy started from here. BJP MLAs were reportedly raising anti-Trinamool slogans during the national anthem. The allegation was that the national anthem had been insulted. The complaint was first submitted to the Assembly Speaker and later an FIR was registered at Hare Street Police Station.

BJP MLAs were summoned from Lalbazar in this matter. BJP went to the High Court challenging the FIR. Last Monday, the Calcutta High Court had said that no action could be taken against the 11 MLAs till Thursday. The stay on cases against BJP MLAs over the national anthem was further extended on Thursday. Justice Sengupta also said that the police should be present in the court with the case diary on the next hearing of the case. On Monday, the police could not show the case diary of the case to the court.
