Supreme Court to hear Delhi government’s plea against Center on July 10

New Delhi : The Supreme Court has agreed to hear Delhi government’s challenge petition against the central government’s ordinance to control services in Delhi. According to media reports, the Supreme Court has agreed to hear the petition filed against the central government’s ordinance and will hear the matter on July 10. As per media reports, the Supreme Court has agreed to list on July 10, 2023, a petition filed by the Government of National Capital Territory of Delhi (GNCTD) seeking an order on behalf of the Central Government to control recently serving civil servants. For this, the ordinance brought to take away the powers of GNCTD was challenged.

Challenge to the constitutionality of the ordinance

The matter was mentioned by senior advocate Dr. Abhishek Manu Singhvi, appearing for the Delhi government, before a division bench of Chief Justice of India (CJI) DY Chandrachud, Justice PS Narasimha and Justice Manoj Mishra. First of all, CJI DY Chandrachud said in his remarks that the hearing of this case can be done along with another similar case pending before the court. The CJI was referring to Delhi government’s plea challenging the constitutionality of Section 45D of the Government of National Capital Territory of Delhi (Amendment) Ordinance, 2023. The petition also challenged the decision of the Lieutenant Governor (LG) of Delhi to appoint the former Allahabad High Court judge.

Ending the services of experts will suffocate the government: Kejriwal

On the other hand, Delhi Chief Minister Arvind Kejriwal said in a statement on Thursday that the move to end the services of experts and advisors will completely suffocate the Delhi government and its services. He hoped that the Supreme Court would reject the move. Delhi Lieutenant Governor VK Saxena had recently terminated the services of around 400 ‘experts’ appointed by the Kejriwal government in various departments. After this, the Delhi Services Department on Wednesday wrote a letter to all departments, boards, commissions and autonomous bodies under the Delhi government, directing them to stop the appointment of people as ‘fellows’ and consultants without the approval of the Lieutenant Governor.

LG takes action on alleged irregularities in recruitment of experts

Chief Minister Arvind Kejriwal tweeted that this step will completely suffocate the Delhi government and its services. I do not know what the Honorable Lt Governor would achieve by doing all this? I hope that the honorable Supreme Court will immediately dismiss it. Lieutenant Governor VK Saxena has terminated the services of around 400 ‘experts’ appointed by the Arvind Kejriwal government in various departments, citing alleged irregularities in recruitment.
