Supreme Court stays NGT’s decision, relief to Kejriwal, blow to LG

Supreme Court Delhi government and Arvind Kejriwal have got a big relief from the decision of LG VK Saxena. In fact, the Supreme Court of the country had appointed Lieutenant Governor Vinay Kumar Saxena as the chairman of a high-level committee on the Yamuna Rejuvenation Project, on which the Kejriwal government had challenged this decision of the NGT in the Supreme Court.

Supreme Court stayed the decision of NGT

On the other hand, the Kejriwal-led Aam Aadmi Party government had demanded an immediate stay on the NGT order from the Supreme Court, the government had said in the court that this would lead to more conflict between the two authorities. Here, CJI DY Chandrachud and Justice PS Narasimha, who are hearing the case, put a stay on the decision of the NGT while giving an interim order on the petition of the Kejriwal government. Only a few courts made it clear that it was staying that part of the January 9 order of the NGT in which the LG was named as the head of the Yamuna panel.

Senior advocate Abhishek Manu Singhvi presented the case for the Delhi government.

Senior advocate Abhishek Manu Singhvi, who appeared on behalf of the Delhi government, argued before the bench that the DDA had nothing to do with cleaning the Yamuna and the NGT was completely wrong in involving the LG. The court had asked, “We are of the view that the real issue is whether the tribunal can appoint the LG as the head of the panel.” NGT believes that since he is the chairman of DDA, he should be made the head of the panel.

Next hearing will be after four weeks

At present, a stay has been imposed in this matter, the next hearing will be after four weeks. The AAP government had approached the Supreme Court in the last week of May. Describing the NGT order as unconstitutional, demanded a stay on it. The Delhi government had also referred to the decision given by the Constitutional Bench of the Supreme Court in July 2018 and on May 11 this year.
