Supreme Court stays HC’s decision declaring UP Madrasa Board Act unconstitutional

Lucknow: The Supreme Court has stayed the order of the Allahabad High Court declaring the Uttar Pradesh Madarsa Education Board Act unconstitutional. The Lucknow bench of Allahabad High Court had stayed the Uttar Pradesh Madrasa Education Board Act 2004. In this case, the board’s lawyer Abhishek Manu Singhwani said that there is no basis for the High Court to cancel this Act. 17 lakh students and 25 thousand madrassas were affected by this decision. The Supreme Court has issued a notice to the Central and Uttar Pradesh governments on the petition challenging the order of the Allahabad High Court. The court has given time till May 31 to the UP and Central governments for this.

Answer sought from UP government, hearing will be held in July
The Supreme Court, while seeking answers from the UP government, said that the matter will be heard in the second week of July. Then this ban will continue. After this decision of the Supreme Court, education in madrasas will continue as per the Act of 2004. This case was heard by the bench of Chief Justice DY Chandrachun, Justice JB Pardiwala and Justice Manoj Mishra. It is being told that the board’s lawyer Abhishek Manu Singhvi said that there are very good Gurukuls in Haridwar and Rishikesh. My father also has a degree in one of them. Should we close Gurukul? Would it be right to stop it by calling it a religious education?
