SC’s interim stay on the order of Allahabad High Court in Shri Krishna Janmabhoomi Shahi Eidgah case

Lucknow: The Supreme Court has stayed the Allahabad High Court order appointing a commissioner to inspect the mosque in connection with the Shri Krishna Janmabhoomi-Shahi Idgah Mosque dispute in Mathura. The Supreme Court has sought response from the Hindu organization ‘Bhagwan Shri Krishna Virajman’ and others on the petition of the Mosque Committee against the High Court order on the survey of Shahi Idgah. The next hearing will be held on January 23. However, the court has been asked to continue the hearing.

The bench of Justice Sanjeev Khanna and Justice Dipankar Dutta has imposed this ban while hearing the petition of Shahi Idgah Masjid Committee. Mosque Committee’s lawyer Tasneem Ahmadi said in the Supreme Court that when the case of dismissal of the petition of Mathura case under the Places of Worship Act 1991 is pending, then the High Court cannot order a survey. Considering this argument to be correct, the Supreme Court has issued an order to stay the order of the High Court. It is noteworthy that Allahabad High Court in its order had asked to appoint an Advocate Commissioner. The commissioner was given the responsibility of surveying the mosque.
