Jharkhand High Court has allowed the residents of Jharkhand who have successfully passed the Central Teacher Eligibility Test (CTET) and Teacher Eligibility Test (TET) from neighboring states to participate in the recruitment examination for Assistant Teacher posts in Jharkhand. The Court gave this direction after observing that CTET or TET examination has not been conducted in Jharkhand for many years, and directed the state to conduct such examination every year.

A division bench of Chief Justice Sanjay Kumar Mishra and Justice Anand Sen said, “Since there is a provision in law that TET examination should be conducted every year and for the last many years, no examination has been conducted to test the eligibility of the candidates. To be appointed as a teacher, we are of the opinion that not only those candidates who have CTET certificate and are residents of Jharkhand, but also those candidates who are residents of Jharkhand, who have other qualifications and who do not have any CTET certificate from any neighboring state. The above judgment came on a petition by a group of certain persons, who were qualified to be appointed as primary teachers, praying for a direction to the State to conduct the eligibility test, which has not been conducted for the last eight years. The attention of the Court was drawn to Clause 10 of the Guidelines for conducting TET, in which sub clause (b) provides that a person who has obtained a TET certificate granted by the legislature of any other State/Union Territory Eligibility of the candidate may be considered.

The court advised the state to consider residents of neighboring states having CTET or TET qualification for teaching posts in Jharkhand and sought an affidavit.
