Relief to Swami Prasad Maurya from Lucknow Bench of Allahabad High Court, criminal case for hurting religious sentiments canceled

Lucknow : The Lucknow bench of the Allahabad High Court has given great relief to the National General Secretary and MLC of the Samajwadi Party, Swami Prasad Maurya. A criminal case was registered against Swami Prasad Maurya in 2014 for hurting religious sentiments. Which has now been canceled by the Lucknow Bench of the Allahabad High Court.

This petition was filed on behalf of an advocate. After this Sultanpur ACJM Court had summoned Maurya in IPC 295A. After which Swami Prasad Maurya challenged the decision of the ACJM court in the High Court.

Justice Subhash Vidyarti’s division bench heard

The division bench of Justice Subhash Vidyarti canceled the order of the trial court while hearing this application. The Court held that the order taking cognizance of the complaint and summoning Maurya to face trial for the offense under Section 295A of the IPC without obtaining the mandatory sanction of the Government under Section 196 of the CrPC is not legally justifiable.

This case was registered in 2014

Actually, in 2014 Swami Prasad Maurya was the National General Secretary of BSP. While addressing a gathering in Lucknow, he had made derogatory remarks against Hindu Gods and Goddesses. After this, a case was registered against them, in which statements were recorded by Anil Tiwari complainant and Tej Bahadur Singh and Shravan Pandey.

Giving information in this case, witness Shravan Kumar Pandey had told that Swami Prasad Maurya, while making derogatory remarks on Gods and Goddesses during the public meeting, had said that Gauri Ganesha should not be worshiped in marriage, for which Anil Tiwari A complaint was filed. I myself had testified in this as a witness. Its owner was summoned to the court. LBW was issued in the case. Swamy went to the High Court after being issued LBW.
