Prayagraj: There was a request to direct survey in Mathura Idgah-Shri Krishna Janmabhoomi, HC rejected the petition

Prayagraj: The Allahabad High Court on Monday dismissed the writ petition filed by Shri Krishna Janmabhoomi Mukti Nirman Trust. Through this petition, a request was made to direct the Civil Judge of Mathura to decide on the application for scientific survey of Krishna Janmabhoomi-Shahi Masjid Idgah before deciding on the objection filed by the opposite party.

Justice Jayant Banerjee dismissed the writ petition filed by Shri Krishna Janmabhoomi Mukti Nirman Trust after hearing the arguments of the petitioner’s counsel Suresh Kumar Maurya and UP Sunni Central Waqf Board’s counsel Puneet Kumar Gupta. Earlier, the petitioners had filed a suit along with a map before the Civil Judge of Mathura in January 2023 requesting to protect their interest and constitutional rights. Along with this, it was also requested that Krishna Janmabhoomi should be restored at the place where Shahi Masjid Idgah is present.

However, the Management Committee of Shahi Masjid Idgah and the UP Sunni Central Waqf Board had raised objection regarding the maintainability of the said suit saying that the suit is against the Places of Worship Act, 1991, which provides that on August 15, 1947 The nature of any existing religious place cannot be changed.
