Maliana victim challenged the acquittal of 41 accused in the High Court, the court summoned the record of the lower court

Lucknow. A month after the acquittal of 41 accused in the Maliana massacre case “for lack of evidence”, the Maliana victim has challenged the acquittal of 41 accused in the Allahabad High Court. The Allahabad High Court has accepted this new petition challenging the order of the lower court. Due to this, a ray of hope has been seen again among the survivors. On 23 May 1987, 68 Muslims were killed by a mob, which allegedly included personnel of the Uttar Pradesh Provincial Armed Constabulary (PAC).

Petition filed on behalf of massacre victim Raees Ahmed

A petition has been filed on behalf of Rais Ahmed, the victim of the massacre. Advocate Riyasat Ali Khan submitted that the matter (Criminal Appeal u/s 372″ No. 136/1987) was listed in Court No. 48 presided over by Justice Siddharth Verma and Justice Manish Kumar Nigam. Court perused the trial court’s record in this regard. We hope that the hearing on the petition will start soon. Khan said, “The case will be fought by lawyer Syed Shahnawaz Shah in the High Court.

In Hashimpura also the accused were acquitted by the lower court

The killings in Maliyana, a village about 10 km west of Meerut, came a day after a massacre in Hashimpura in the city, in which PAC personnel shot dead at least 38 Muslims in custody. In October 2018, the Delhi High Court sentenced 16 former PAC personnel to life imprisonment for “targeted killing”. As in the case of the Maliana accused, a lower court acquitted the Hashimpura convicts in 2015, saying their guilt had not been established beyond doubt. But the Delhi High Court had sentenced 16 PAC personnel in 2018.

Riots took place over the reopening of the locks of the Babri Masjid.

Riyasat Ali Khan said, “We have full faith in the judiciary and hope that the families of the victims and the survivors can get justice like their brothers in Hashimpura.” The massacres at Hashimpura and Maliana took place at a time when communal tensions, triggered by the reopening of the locks of the Babri Masjid in February 1986 in Meerut district, were at their peak.
