Jharkhand High Court stays the order to attach the entire property of FFP Building

Ranchi: Jharkhand High Court, while hearing the petition filed by the Transport Department of the State Government, has stayed the order of the Commercial Court to attach the entire property of the department located in the FFP Building. While hearing the case, the division bench of Chief Justice Sanjay Kumar Mishra and Justice Anand Sen stayed the orders given by the Commercial Court on 13 July 2023 and 24 November 2023. Also, the defendant in the case, M/s KS Softnet Solution Pvt Ltd, was directed to file a counter affidavit within four weeks. The next hearing of the case will be on January 24.

Earlier, Additional Advocate General Sachin Kumar, appearing on behalf of the state government, told the bench that an appeal and stay petition is pending against the interim award of the Commercial Court. Meanwhile, the Commercial Court has passed orders to attach the property. The Additional Advocate General requested for a ban on this, which was accepted by the Division Bench. It is noteworthy that on December 5, on the orders of the Commercial Court, the entire property of the Transport Department located at the FFP Building was attached. The state government has filed a petition against this.

In 2004, the Transport Department had signed an agreement with Mumbai-based company M/s KS Softnet Solutions Pvt. Ltd. to build nine integrated check posts. Even after two years, the company was given land at only five places. Even on that, clearance was not given from various departments. On April 12, 2013, the work was stopped by the then Chief Secretary in view of other problems including land acquisition. When the outstanding money was not given to the company by the state government. Then a case was filed by the company in the Commercial Court Ranchi. On July 13, 2023, the court passed an order to confiscate the property of the Transport Department, but there was no cooperation from the district administration, due to which the court order could not be followed. After this the court again issued an order to attach the property. The company owes more than Rs 10 crore six lakh 71 thousand to the Jharkhand government. Interest at the rate of 15 percent also has to be paid on this amount.
