Ranchi: Jharkhand High Court has ordered to give mining scam accused Sunil Yadav (brother of Dahu Yadav) on remand for five days. This is the first incident of giving additional five days remand to an accused of money laundering after the 15 days remand is over. In the light of the High Court order, the ED will take him on remand and interrogate him. After this, charge sheet will be filed against him in two-three days.
Sunil Yadav remained absconding for a long time after the warrant was issued from the PMLA court. In the light of the warrant issued by the court, Sahibganj police arrested him on the night of 25 August 2023. Following the court order on 26 August, he was sent to Birsa Munda Central Jail. After being sent to jail, ED took him on remand for questioning in the mining scam. After being interrogated for 15 days, he was sent to jail in the light of the court order. However, during the investigation into illegal mining, ED felt the need to take him on remand and interrogate him.
so Edfiled an application in PMLA court and demanded to give the accused remand for additional five days. The PMLA court rejected the ED’s application after hearing the arguments of all the parties in this case. In this case, the order passed by the court said that under the provisions of CrPC, the accused can be given remand only for 15 days after being sent to judicial custody. Therefore the accused can no longer be given additional remand.
ED approached the High Court:
After Sunil Yadav’s remand petition was rejected by PML court, ED filed a petition in the High Court. This petition was heard on October 12 in the court of Judge Sanjay Kumar Dwivedi. The court sent a notice to the accused through Birsa Munda Central Jail to present his side on this petition. Also, the date of hearing was fixed for October 16.
During the hearing on the scheduled date, the accused’s demand for additional police remand was opposed and said to be contrary to the provisions of CrPC. Citing the Supreme Court’s decision in the case of ‘V Senthil Balaji vs ED’, the ED requested for additional police remand. The court gave the above order after hearing the arguments of all the parties.
