Jharkhand High Court orders CBI probe in Sahibganj illegal mining case, questions raised on police working style

In the investigation of the FIR registered in the case of illegal mining at Sahibganj’s Lemon Mountain, the police showed the location of the complainant in Bengaluru and Karnataka. The police only investigated the allegations of SC-ST Act and not illegal mining. This indicates that the police is trying to save the accused in this case. Judge Sanjay Kumar Dwivedi has mentioned this in his decision given after hearing the petition of Vijay Hansda. Along with this, it has been ordered to be investigated by the CBI. The court has also ordered the Sahibganj police to protect the life and property of the petitioner.

During the hearing of Vijay Hansda’s petition (665/2922), a request was made to dismiss the petition opposing the demand for a CBI inquiry by the government. On behalf of the ED, the seriousness of the matter and the involvement of people of criminal character including Prem Prakash and other criminal characters and not conducting a proper investigation by the police were cited.

The court remarked in the light of the report presented regarding the investigation in the FIR lodged by Vijay Hansda that only the point of the SC-ST Act has been investigated in it. The police have not investigated the allegations of illegal mining leveled in the FIR. In the report presented by Rajendra Dubey, the investigating officer of this case, it was mentioned that on the day Vijay Hansda lodged this FIR regarding the incident of illegal mining at Nimbu Pahar, the location of the phone number 9934527037 was Bengaluru and Karnataka. I tells.

The DSP said this on the basis of the details given by the technical cell. On the other hand, ED has said that the police deliberately asked the location technical cell for the phone of Bangalore resident Vinod Prasad instead of Vijay Hansda. Its purpose is to influence the investigation of illegal mining carried out by ED. ED inspected the FIR lodged by Vijay Hansda after registering it as CSIR. In this, illegal mining was confirmed on Lemon Mountain.

Court took ED’s facts seriously

In the case relating to withdrawal of the original petition by Vijay Hansda, the Court observed on the basis of evidence that the petition was filed on the basis of Vakalatnama verified and signed by the competent authorities of the jail. The court has not considered the NOC given for changing the lawyer in this case as justified. The court has said that some mind is working behind this, who is trying to cover up the whole matter.

After listening to all the parties, the court presented the decision given by the Supreme Court in the case of ‘Samaj Parivartan Community Vs Karnataka Government’ as an example. In this, the court said that if there is an allegation of involvement of the Chief Minister or influential people in any case, then such a case should be handed over to an independent investigation agency for fair investigation.
