Jharkhand High Court imposed a fine of Rs 1 lakh on Hazaribagh district administration, know the whole matter

Ranchi: The court of Justice Anand Sen of Jharkhand High Court heard the petition challenging the order of making a drain by the Municipal Corporation on the Raiati land in Bindeshwari Path of Hazaribagh. After hearing everyone’s side, the court asked why a drain was constructed on the raiyat land without acquiring it. The court directed Hazaribagh district administration to pay Rs 1 lakh to the applicant as fine. Also said that the amount should be paid within four weeks.

The court directed the Deputy Commissioner to investigate the matter and recover the amount by deducting it from the salary of the concerned responsible officer, who has constructed the drain without acquiring the land. The court also said that after taking action to acquire the land, the fixed compensation amount should be paid to the applicant. Hazaribagh Deputy Commissioner, SDO and Municipal Commissioner of Hazaribagh Municipal Corporation were physically present during the hearing of the case. Earlier, advocate Rajendra Krishna appeared on behalf of the applicant.

It is noteworthy that the petition was filed on behalf of applicant Shailendra Kumar Gupta and others. It was said that Hazaribagh Municipal Corporation has constructed a drain on his raiyat land situated on Bindeshwari Path without acquiring it. An FIR has also been lodged against Shailendra Kumar Gupta and his brother Sushil Kumar Gupta under case number 293/2022 in Hazaribagh Sadar police station for opposing the construction of the drain. The applicants have also challenged the said FIR by filing a separate petition.
