Jharkhand High Court bans strict action against accused in Vijay Hansda threat case

The High Court has banned taking coercive action against Mukesh Yadav and Ashok Yadav, who have been made accused by Vijay Hansda. Besides, notices have been issued to the state government, CBI and ED and directed to respond. Vijay Hansda has filed an FIR against both of them accusing them of using caste based words and threatening them. This case is currently pending in the court of Additional Justice Commissioner of Ranchi.

Mukesh Yadav and Ashok Yadav have filed a writ petition and requested to get the FIR (240/2023) registered in Dhurva police station investigated by an independent investigating agency from outside the state. In this, the state government, CBI and ED have been made defendants. The hearing of this petition was held on Thursday in the court of Judge Sanjay Kumar Dwivedi. In the case, the court has issued notice to the state government, ED and CBI and directed them to file their reply.

Mukesh Kumar said in his petition:

Vijay Hansda asked for money in the name of the petition – In the petition filed on behalf of Mukesh Yadav, it was said that he does water transportation work in Sahibganj. Vijay Hansda contacted him while he was in jail and said that illegal miners had implicated him in a false case and sent him to jail. He has lodged an FIR (6/2022) against these people on charges of illegal mining and using caste based words. But, he does not trust the police investigation. After this, on his request, a petition (655/2022) was filed in the High Court.

After hearing this petition, the High Court has ordered a CBI investigation into the FIR lodged by Vijay Hansda. After coming out of jail, Vijay Hansda called him (Mukesh) and demanded money to continue the hearing of the petition filed in the High Court. Said that an accused in FIR No. 6/2022 lodged by him is ready to pay a lot of money to withdraw the petition filed in the High Court. On August 16, Vijay Hansda was seen with the accused of this FIR named Vishnu Yadav. Some ED officers had also reached the court, who were talking to Hansda regarding the reasons for not testifying in the PMLA court. Vijay Hansda lodged an FIR at Dhurva police station. In this, an FIR was lodged against the petitioner for threatening and under SC, ST Act. This has been done at the behest of influential people involved in illegal mining.
