Jharkhand: Hearing in the High Court today on the petition challenging the arrest of Hemant Soren.

Ranchi: The hearing on the petition challenging the arrest of Hemant Soren will be held in the High Court on February 5. The Supreme Court refused to hear his petition and directed him to approach the High Court. After this, a complaint was filed in the High Court on behalf of Hemant Soren. A petition has been filed to amend the petition. In the original petition filed in the High Court, a demand was made to declare the summons of the Enforcement Directorate (ED) as illegal and to ban the coercive action, but by amending it, a demand has been made to declare the arrest wrong.

The Supreme Court had given instructions to go to the High Court

After ED raided the Chief Minister’s Delhi residence on January 29, Hemant Soren had given time for questioning on January 31. Besides, a petition was filed simultaneously in the High Court and the Supreme Court demanding that the summons issued by the ED be declared against the rules and the coercive action be banned. Due to the Supreme Court fixing the date of hearing on February 2, the High Court had fixed the date of hearing on Hemant Soren’s petition as February 5. The Supreme Court refused to hear the petition and directed it to go to the High Court.

ED officers are using powers which were not given to them

In the petition filed in the High Court on behalf of Hemant Soren, it was said that ED officials are using powers which have not been given to them in PMLA-2002. They are being targeted because the general elections are near. BJP MP Nishikant Dubey has filed a complaint against his father in the Lokpal court. CBI conducted wrong investigation in this case. CBI investigated and presented three reports in the Lokpal court. In this, those properties have been described as our family property, which do not belong to us. After this, ED first issued summons to the petitioner (Hemant Soren) in the illegal mining case. In the light of this summons, he recorded his statement. After this, summons started being sent to him in FIR number 272/23 registered in Sadar police station. The property for which he was summoned for questioning by the ED is not his property at all. Yet the ED continued to send summons to him in this case.

His arrest is against the rules

ED’s summons were challenged in the Supreme Court and a request was made to ED to stop sending summons till the case is resolved, but ED continued sending summons. In the light of the FIR filed by ED against the revenue employee in Sadar police station, IIR was registered. He is not an accused in the FIR lodged at the police station. Nevertheless, the ED arrested a property claiming it to be that of the petitioner, which was not in his name. Therefore his arrest and remand are against the rules. In view of these circumstances, the petition has requested the court to declare the arrest and remand as illegal.

Hemant Soren was interrogated for the second day also

Here, former Chief Minister Hemant Soren was interrogated by ED officials for the second day on Sunday at his office on Airport Road. At 11.30 am, a three-member medical team examined Hemant Soren’s health. Apart from Dr. Harish Chandra, this medical team included Preeti Tigga and Neetu Toppo. Extensive arrangements were made for security outside the ED office. Jharkhand Police, CRPF personnel along with water cannons, fire fighting vehicles and Vrajvahan were also deployed outside the gate.
