How many times can one ignore ED summons? Know what the law says

Enforcement Directorate (ED) has arrested Delhi Chief Minister in money laundering case related to excise policy. Arvind Kejriwal Summons have been issued for the second time for questioning on 21st December. He was called to appear for the first time on November 2, but he did not appear before the investigating agency alleging that the notice was politically motivated and not tenable as per law. What options does ED have?

If a person refuses to appear before the ED, then the investigating agency issues summons for the second time. If the person still does not appear, then a second summons is issued to him. If needed, ED can also give time to the person. But if the person does not turn up for questioning even for the third time, then the ED is free to take legal action. Not only this, ED can file an application before the court to issue non-bailable warrant against the person. ED can also arrest the person after issuing non-bailable warrant.

What is Delhi Excise Policy issue?

The policy was later repealed and the Lieutenant Governor of Delhi recommended a Central Bureau of Investigation (CBI) investigation, following which the ED registered a case under the Prevention of Money Laundering Act.

AAP alleges conspiracy to destroy the party

After the first summons, AAP had alleged that Kejriwal would be arrested as part of a BJP conspiracy to target India’s top leaders ahead of the 2024 Lok Sabha elections and that the ED notice was an attempt to dismantle the party, which Is in power in Delhi and Punjab. The ED has mentioned Kejriwal’s name several times in its charge sheet filed in the case and said that the accused were in touch with him regarding the preparation of the now canceled Delhi Excise Policy 2021-22.
