Justice Shekhar Kumar Yadav gave this order while hearing the bail application of Aman, accused of gang rape in Moradabad. The matter is of Bhagwatpur police station area of ​​Moradabad district. In this case, a case of gang rape and Dalit harassment was registered on behalf of the victim against the accused Aman and many others. The police arrested the petitioner and sent him to jail. When the hearing started in the district court after the charge sheet was filed against the petitioners, the victim retracted her allegations. The accused had approached the High Court after his bail was rejected by the district court.

The petitioner’s lawyer SF Hasnain argued that the petitioner has not committed the alleged crime. The FIR was lodged late for which no explanation was given. There are contradictions in the statements of the victim. During the trial, the person who lodged the FIR and the victim herself admitted that the petitioner and other co-accused did not rape her. Nor did they all call the victim and take her to the fields. On this basis he has been declared a traitor. Even medical examination does not confirm rape of the victim. Taking the matter seriously, the court granted conditional bail to the accused. The court has directed the subordinate court that if this case is found to be false then it should take strict action against those who file false FIR and retract their statements during the hearing. Along with registering a criminal case against such people, the financial assistance received from the government should also be recovered along with interest. The court has also directed to send a copy of the order to the concerned subordinate court and DM for compliance.

In which first FIR is lodged under Rape, POCSO Act and SC-ST Act, on the basis of which investigation is carried out. The victims receive government compensation and after a long time, they retract their statements during the hearing. The result of fake cases is that not only does a lot of the life of the innocent accused get wasted in the time taken for prosecution, they also have to endure financial and mental pain.
