Hearing postponed in SC on the petition of Uddhav Thackeray group, Maharashtra Assembly Speaker’s decision was challenged

The court on Monday postponed the hearing on the petition challenging Maharashtra Assembly Speaker Rahul Narvekar’s order declaring the Shiv Sena faction led by Chief Minister Eknath Shinde as a real political party. After Shinde’s separation, there was a split in Shiv Sena in June 2022.

The Thackeray faction’s petition was listed for hearing on Monday but due to paucity of time the matter could not be heard during the day. Senior advocate Kapil Sibal, appearing for the Thackeray faction, told a bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra. Eknath Shinde Let the group file its reply. Notice was issued earlier. The Chief Justice said, we will list it.

Meanwhile, senior advocate Harish Salve, appearing for the Shinde faction, said that since a petition on this issue is also pending in the Bombay High Court, the proceedings cannot be conducted simultaneously in two courts. Earlier, on February 5, the bench led by the Chief Justice had agreed to consider listing the Thackeray faction’s petition.

Uddhav Thackeray accused Shinde of capturing power unconstitutionally

It is noteworthy that the Uddhav Thackeray faction alleges that Eknath Shinde captured power unconstitutionally and is leading an “unconstitutional government” in Maharashtra. Assembly Speaker Narvekar, in his order passed on January 10, suspended 16 members of the ruling camp, including Shinde. The Thackeray faction’s petition to disqualify the MLAs was also rejected.
