HC gives verdict in Shri Krishna Janmabhoomi-Shahi Eidgah case, approves appointment of commissioner for survey

Allahabad High Court on Thursday gave a big decision in the Shri Krishna Janmabhoomi-Shahi Idgah Mosque dispute case of Mathura. The court accepted the petition of the Hindu side and accepted the application to appoint a court commissioner for the survey. The single bench of High Court Justice Mayank Kumar Jain, while hearing the case, rejected the arguments of the Waqf Board. During the hearing on this application on November 16, the High Court had reserved its decision after hearing both the parties. On this day, 17 out of 18 petitions regarding the disputed premises were heard. All these petitions were transferred from Mathura District Court to Allahabad High Court for hearing. One of these petitions was to send it to the Court Commissioner. Justice Mayank Jain of Allahabad High Court heard the cases one by one. Applications and affidavits were filed on behalf of the parties. Some filed a party and some filed an amendment petition. After this, the court gave time to the opposition to file replies on civil suits and petitions. One party, while keeping the mythological aspect of the temple, said that the grandson of Lord Shri Krishna had built the Mathura temple. Land was donated for the temple. Therefore there is no dispute over ownership of the land. There is a dispute about demolishing the temple and building a royal mosque. In the revenue records, the land is still registered as Katra Keshav Dev’s Dham. The Hindu side has called this decision a big victory.

In this case, the Muslim side had lodged an objection under 7 Rule 11, calling the petition non-maintainable. The lawyer of Shahi Idgah Mosque and UP Central Waqf Board has lodged an objection in the court. Muslim parties say that this petition is not worth hearing and it should be dismissed. An agreement was reached on 12 October 1968 in the Shri Krishna Birthplace Shahi Idgah case. In this agreement signed between Shri Krishna Janmabhoomi Seva Sangh, an associate organization of Shri Krishna Janmasthan Trust, and Shahi Idgah, out of 13.37 acres of land, about 2.37 acres of land was given for Shahi Idgah. However, after this agreement, Shri Krishna Janmabhoomi Seva Sangh was dissolved. The Hindu side is calling this agreement illegal. According to the Hindu side, Shri Krishna Janmabhoomi Seva Sangh had no right to negotiate.
