Now the court has ordered the grandson to return home, which has created a wave of happiness in the family.

The petitioner and his family have waited for 48 years for the allotment of the house again. During the hearing of the case, the court said that the delay in allotment was due to discrepancy in the size of the flat. But the court ruled in favor of the petitioner and ordered MHADA to allot a 579 square feet flat. Justices Gautam Patel and Kamal Khatta said that we have been told that it cannot be allotted because the house in question is of 579 square feet and the applicant has the right to only 300 square feet. According to the plea of ​​34-year-old Ravindra Bhatuse, in November 1975, his grandfather was issued a notice to vacate his 106-square-foot room in Zainab Manzil, Byculla. After this he went to the village.

Eligible for flat in 2010

At the same time, on this matter, the judges said that an entire generation was lost. The second generation has partially left, but even after this the petitioner was not rehabilitated. In February 2010, the petitioner was declared eligible for permanent alternative accommodation. Before the High Court, his advocates Yashodeep Deshmukh and Akash Jaiswal said that despite repeated inquiries and representations, the premises were not allotted as per entitlement.

Asked to pay for extra space

During the hearing it was clarified that Bhatuse would pay the ready reckoner rate or the market value, whichever is higher, for the additional 279 square feet. Bhatuse was given one month’s time to make the payment to MHADA and directed that he would be given possession of the apartment within 24 hours of payment.
