Governor CP Radhakrishnan returned Jharkhand Finance Bill for the fourth time, calling it interference in the rights of the Central Government.

Ranchi: Jharkhand Governor CP Radhakrishnan has once again returned the Jharkhand Finance Bill sent by the Jharkhand Assembly with objection. The Governor has returned the bill for the fourth time. This time the Governor has said that the kind of amendments and provisions have been kept in the Finance Bill. This is complete interference in the authority of the central government. The provisions and amendments made by the State Government and the Legislative Assembly are not within their jurisdiction. Only the Central Government has the right to make or amend provisions. The Governor has mainly raised objections on three points.

The Governor had also taken opinion from the Attorney General
Before returning the bill, the Governor had also taken opinion from the Attorney General. The Governor objected to the provision given in section (26) of the bill and said that custom bonds are included in the central list. Making any changes in this is beyond the authority of the state government. Similarly, the Governor has said about the provision given in Section (30) of the Bill that it is influenced by the Attorney General of the country and the Indian Bar Act. This matter is related to the Attorney General, Advocate and India Bar Council. The state government cannot change any provision related to this. Apart from this, the Governor has also expressed objection to section (30) of the bill. Rejecting the provision given in it, he has said that this is also an interference in the rights of the Central Government. A bill was prepared to amend the Indian Stamp Act 1899 and Bihar Entertainment Duty, Court Fees and Stamp Act 1948 (as applicable in Jharkhand). Before this, the Governor has thrice returned the Jharkhand Finance Bill-2022 with objections.

What provisions have been made
In Section (26) of the Jharkhand Finance Bill 2022 prepared by the Jharkhand Assembly, the stamp duty has been kept at Rs 100 for customs bonds where the value does not exceed Rs 5,000. Similarly, if the amount is more than Rs 5,000 but not more than Rs 10,000, the stamp duty has been kept at Rs 200. In section (30) the fee is fixed at Rs 1000. Whereas in Section 50, the fee for written declaration made by a notary public has been fixed at Rs 50.
