Calcutta High Court rejected the new panel formed for appointment to the post of police constable in Bengal.

In the matter of appointment to the post of constable in West Bengal Police Calcutta High Court Has given an important decision. While hearing the case on Wednesday, the division bench of High Court Chief Justice TS Sivagananam and Justice Hiranmoy Bhattacharya canceled the new panel made for appointment to various police posts in the state and declared the old panel valid on its basis. An order has been given to appoint. The panel for appointment of constables was published on 24 February 2022. The division bench said that instead of this new panel, appointments to the post of constable will have to be made on the basis of the panel published on March 26, 2021. In the examination conducted for appointment, many candidates of SC, ST and other reserved categories have obtained more marks than the general category candidates. They will have to be recognized as general category. There is such a rule in the state law also.

However, challenging the old panel, some general category candidates had filed a case in the State Administrative Tribunal (SAT) and the SAT directed to remove the reserved category candidates from the general category table and include them in the reserved category table. Challenging this decision of SAT, reserved category candidates had filed a petition in the High Court, hearing which on Wednesday, the High Court canceled the decision of SAT and ordered to appoint constables as per the old panel.

West Bengal Police Recruitment Board had issued a release on February 3, 2019 for the appointment of 8419 constables. On the basis of this, the written examination was held on August 8, 2019 and the panel for appointment was published on October 15, 2020. After this, on March 10, 2021, a case was filed before SAT alleging irregularities in the appointment process. On January 28, 2022, SAT directed to remove reserved category candidates from the general category table and include them in the reserved category table and ordered the recruitment board to publish a new panel within four weeks.

A petition was filed in the High Court against this decision of SAT and the High Court canceled the decision of SAT. According to the information, according to the second panel, out of the constables who have been appointed, 137 people may lose their jobs. However, the Chief Justice said that instead of canceling their jobs, they should be appointed elsewhere. On this, it has been told by the state that still 200 constable posts are vacant, hence there will be no problem in appointing these 137 candidates.
