Calcutta High Court: Calcutta High Court lifts prohibitory order under section 144 in Sandeshakhali

Protests have been going on in this area for the last one week. Two residents of Sandeshkhali had filed a petition requesting the court to issue directions to lift the prohibitory order from the area. On February 9, prohibitory order was imposed under Section 144 of CrPC in Sandeshakhali in North 24 Parganas district of West Bengal and internet services were suspended. According to the judge, Section 144 should have been issued by identifying the sensitive areas and not the entire Section 144 should have been issued in the area.

This was done to reduce people’s rights

Justice Jai Sengupta had quashed Section 144 of CrPC imposed by the district administration of Sandeshkhali and said that the way it was done was not right. Petitioner’s lawyer Bikash Ranjan Bhattacharya claimed that the prohibitory order in Sandeshkhali is not a ground to be imposed and it was done to curtail the rights of the people. The state opposed the prayer, claiming that it also had to be seen whether there was sufficient basis for such protests and whether some of the movements allegedly led to violence.

Police has not received any complaint for three years

Commenting on the state, Justice Sengupta said that women in that area were feeling unsafe and the police had not received any complaint for the last three years. The court cannot close its eyes after so many allegations. After this decision, Trinamool leader Tapas Roy said, “A terrible situation is going on in Sandeshkhali. Local administration and police have a role in this. If in every case the police-administration is directed by the court in the same way, then there can be problems. Honorable Chief Minister is making every possible effort to ensure that this problem does not occur. Everyone is worried about Sandeshkhali. We all must ensure that there is no further provocation, excitement.
