Calcutta High Court allowed Kunal Ghosh to go to Spain, said foreign travel is a fundamental right

Calcutta High Court has given permission to Kunal Ghosh to travel abroad. Saradha case accused and Trinamool spokesperson Kunal Ghosh said that the CBI had raised objection to his foreign travel. The Calcutta High Court on Tuesday rejected the objection and said that traveling abroad is a fundamental right. Apart from this, Kunal has already gone abroad and till now he has not been accused of breaking the law during his foreign trip. State Chief Minister Mamata Banerjee is going to a business conference in Spain on 12 September. A delegation is also going with him. Kunal, the spokesperson of the ruling party in the state, is going to Spain as a member of the delegation. But since he is an accused in a case under investigation by the state, the CBI probing it had barred him from traveling abroad.

The division bench of High Court comprising Justice Jaimalya Bagchi and Justice Gaurang Kanter heard the case on Tuesday. Justice Bagchi said that even though Kunal has been accused, the allegations against him have not yet been proved. Therefore, foreign travel cannot be banned. Apart from this, CBI could not tell what impact Kunal’s going abroad would have on the investigation. The central agency could not present any evidence to support its claim in this regard. Kunal’s lawyer Ayan Chakraborty said that after this, a two-judge bench rejected the CBI’s objection and allowed Kunal to travel abroad.

Kunal should return his passport by 25th September

In Kunal’s case, the Division Bench of the High Court has ordered that Kunal will be able to go abroad on September 12. He can stay there till 23 September. Kunal Ghosh may participate in the business conference in Spain as a member of the state delegation. Kunal has already been to Singapore and returned as per the rules of law. There have been no allegations against him of violating the law during his trip abroad. However, even if he gets permission to travel abroad, Kunal will have to deposit Rs 5 lakh. Kunal’s lawyer said that the High Court has ordered that Kunal will return his passport by September 25 after returning from his trip to Spain.
